Non serious injuries


In terms of the Road Accident Fund Act and Regulations, the Minister of Transport is to publish a list of injuries which may never be regarded as serious.  A draft list of such injuries has been published and the draft regulations in the Government Gazette dated the 22nd of August 2012.  Such list is indeed controversial; the effect is that it prohibits an injury from being assessed as serious if it is an injury which is described on the schedule list.  This effectively means that even if an injury is indeed serious, according to medical and expert evidence.  In a particular case, those doctors are prohibited from classifying it as serious, purely based on the fact that it is an injury contained on the draft list.
